Mediation is fast becoming a popular alternative to litigation and the courts are highly supportive of attempts to mediate ahead of a case being heard in the hope that it will settle.  Many do.

Mediation enables the parties to maintain control over their dispute resolution method rather than place themselves in the hands of a third party decider, such as an adjudicator or a judge.  Creative settlements can be found that might not otherwise be available in an adversarial process.  There are better prospects too of preserving commercial relationships through a settlement that both parties can live with.

Our consultants are skilled surveyor-advocates and can help you prepare for participation in a mediation and/or present your case for you.  They will also accept appointment as a mediator in appropriate situations.

We have also developed a bespoke form of mediation which we call 'Executive Dispute Resolution'.  This combines mediation with a form of alternative dispute resolution known as the 'mini-trial'.  This structured negotiation method provides cost and time advantages over both adjudication and mediation methods.
